These Terms of Service (“Terms”) govern your access to and use of thebakekeeper.com and its associated pages (the “Site”), operated by The Bake-Keeper (“The Bake-Keeper,” “we,” “us,” or “our”). By accessing or using the Site, signing up for our Free 7-Day Sourdough Starter Course, using “Save This Recipe,” subscribing to our newsletter, leaving a comment or review, or purchasing anything through the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site. Please also review our Privacy Policy and our Affiliate Disclosure, which are incorporated into these Terms by reference.
1. Eligibility
The Site is intended for a general audience. By using the Site, you represent that you are at least 18 years old, or are using the Site under the supervision of a parent or legal guardian, and that you have the legal capacity to enter into these Terms.
2. Changes to These Terms
We may revise these Terms from time to time to reflect changes to the Site, our practices, or applicable law. The “Last updated” date above will reflect the most recent revision. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
3. Intellectual Property Rights
All original content on the Site – including recipe write-ups, instructions, photographs, videos, graphics, course materials, and The Bake-Keeper name and logo – is owned by The Bake-Keeper or its licensors and is protected by U.S. and international copyright and trademark law, unless otherwise noted. As is generally true for recipes, the underlying list of ingredients and basic functional steps of a recipe are not, by themselves, protected by copyright; however, our original written descriptions, instructions, commentary, photographs, and videos are protected original expression and may not be copied.
4. License to Use the Site
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your own personal, non-commercial use. You are welcome to:
- Link to our recipes and posts from your own site or social media
- Share our content on social media using the sharing tools we provide
- Prepare a recipe in your own kitchen for personal use, and describe your own experience making it in your own words with a credit and link back to us
Unless you have our prior written permission, you may not republish, reproduce, redistribute, or create a substantially similar copy of our original written content, photographs, or videos – including by copying our recipe text or images onto another site, into a cookbook, or into any other publication.
5. Comments, Reviews, and Other User-Generated Content
If you post a comment, star rating, recipe review, or other content on the Site (“User Content”), you grant The Bake-Keeper a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, display, and distribute that User Content in connection with operating and promoting the Site. You are solely responsible for your User Content and represent that you have the right to post it and that it does not violate any law or any third party’s rights.
You agree not to post User Content that is unlawful, defamatory, harassing, obscene, infringing, false or misleading (including fake reviews), or that contains spam, malware, or unauthorized advertising. We do not actively monitor all User Content, but we reserve the right, in our sole discretion, to remove, edit, or refuse to publish any User Content, and to suspend or terminate a user’s ability to post, at any time and without notice.
6. Copyright Complaints (DMCA)
We respect the intellectual property rights of others and expect users of the Site to do the same. If you believe that content on the Site infringes your copyright, please send a written notice to the email address below that includes: (1) a description of the copyrighted work you believe has been infringed; (2) the location (URL) of the material you believe is infringing; (3) your name, address, telephone number, and email address; (4) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (5) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
Send copyright notices to info@thebakekeeper.com with the subject line “Copyright Complaint.” We will review valid notices and may remove or disable access to reported content, in our discretion.
7. Newsletter, Email Course, and Other Communications
Features like the Free 7-Day Sourdough Starter Course, “Save This Recipe,” and our newsletter are opt-in: by submitting the relevant form, you consent to receive the specific emails associated with that signup (for example, the daily course lessons, or the recipe you requested), and, only if you separately check the newsletter opt-in box, our general newsletter. You may unsubscribe at any time using the link included in every email, as described in our Privacy Policy. We are not responsible for emails that are filtered as spam or otherwise not received due to your email provider’s settings.
8. Affiliate Links and Endorsements
The Site participates in affiliate marketing programs, including the Amazon Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by linking to Amazon.com and affiliated sites. As an Amazon Associate, we earn from qualifying purchases. Where we recommend a product, we only recommend products we genuinely use or believe in, consistent with the FTC’s Endorsement Guides, and we disclose our material connection to affiliate links on our Affiliate Disclosure page. Purchases made through affiliate links are transactions between you and the applicable retailer, not with The Bake-Keeper, and are governed by that retailer’s own terms and policies.
9. Recipe, Food Safety, and Health Disclaimer
Recipes, techniques, and any nutritional, allergen, or dietary information on the Site are provided for general informational and educational purposes only and are not a substitute for professional medical, dietary, or nutritional advice. We make reasonable efforts to describe recipes and ingredients accurately, but we do not guarantee the completeness or accuracy of any nutritional or allergen information, and calculations (where provided) are estimates only. If you have a food allergy, sensitivity, or medical condition, you are solely responsible for reviewing ingredient labels and consulting a qualified healthcare professional before preparing or consuming any recipe. You are responsible for using safe food-handling practices (including with raw dough, eggs, and active sourdough cultures) and for exercising your own judgment when baking. Results will vary based on your ingredients, equipment, altitude, and technique, and we do not guarantee any particular result.
10. Shop, Digital Products, and Purchases
Digital content and the Academy. Any digital products, guides, or paid course content we offer are made available for your personal use and are provided “as is.” Outcomes from following our recipes, courses, or guides will vary and are not guaranteed.
Physical merchandise. Where the Site offers physical products for sale (such as baking tools or merchandise), product descriptions, availability, and pricing are subject to change without notice, and we reserve the right to limit quantities or refuse any order. Payment processing for any direct purchase is handled by a third-party payment processor, and by making a purchase you also agree to that processor’s applicable terms.
Local pickup orders. Where we offer fresh-baked goods for local pickup through a third-party ordering platform (currently Our Local Bakery Store), that transaction is between you and us as facilitated through that platform, and is also subject to the third-party platform’s own terms of use. We are not responsible for the availability, functionality, or policies of any third-party ordering platform.
Affiliate/kitchen-essentials purchases. Products marked as affiliate recommendations link out to third-party retailers (such as Amazon). Those purchases are governed entirely by the third-party retailer’s own terms, return policies, and privacy practices, as described in Section 8 above.
Personalized and made-to-order merchandise. Some merchandise on the Site is personalized or produced to order after you purchase it. Because these items are made specifically for you, all sales of personalized or made-to-order merchandise are final, and we do not accept returns, exchanges, or refunds except where an item arrives defective, damaged in transit, or materially different from what you ordered. Production of made-to-order items takes place before shipping, so please allow additional time beyond standard shipping estimates; any timeframes shown on a product page are estimates only.
Returns and refunds generally. Except as otherwise stated on a product page, for personalized or made-to-order merchandise as described above, or as required by applicable law, all sales through the Site are final. If you believe your order was defective, damaged, incorrect, or did not arrive, please contact us at info@thebakekeeper.com within a reasonable time after delivery (or the expected delivery date) so we can make it right.
11. Memberships and Recurring Billing
Some Academy memberships or course plans may be offered on a recurring subscription basis, in addition to free and one-time-purchase options. Where a plan renews automatically, the enrollment page will disclose the recurring price, billing frequency, and how to cancel before you enroll. You may cancel a recurring membership at any time from your account dashboard, effective at the end of the then-current billing period, and we do not provide prorated refunds for a partial billing period except as required by law. We will provide any renewal notice required by applicable automatic-renewal laws.
12. Third-Party Links Generally
The Site may contain links to third-party websites that are not owned or controlled by The Bake-Keeper. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. You access any third-party site at your own risk.
13. Prohibited Uses
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Scrape, republish, or redistribute Site content in bulk or by automated means without our prior written permission
- Introduce viruses, malware, or other harmful code, or attempt to gain unauthorized access to the Site, our accounts, or our systems
- Interfere with, disable, or overburden the Site or attempt to circumvent any security or spam-prevention measures
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Post false, misleading, or manipulated reviews or ratings
- Harass, abuse, or harm another user through comments or other interactive features
14. Termination
We may suspend or terminate your access to any interactive feature of the Site (such as commenting), or block your access to the Site altogether, at any time and without notice, if we believe you have violated these Terms or engaged in conduct that is harmful to the Site or other users.
15. Disclaimer of Warranties
THE SITE AND ALL CONTENT, RECIPES, AND MATERIALS ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY RECIPE OR INSTRUCTION WILL PRODUCE ANY PARTICULAR RESULT.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE BAKE-KEEPER AND ITS OWNER(S) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, ANY RECIPE OR INSTRUCTION, ANY PURCHASE MADE THROUGH OR IN CONNECTION WITH THE SITE, OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY IS NOT VALIDLY DISCLAIMED, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE SIX MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
17. Indemnification
You agree to indemnify and hold harmless The Bake-Keeper and its owner(s) from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Site, your User Content, or your violation of these Terms.
18. Governing Law and Venue
These Terms, and any dispute arising out of or related to them or the Site, will be governed by the laws of the State of Florida, without regard to its conflict-of-laws principles, and, subject to Section 19 below, the state and federal courts located in that state will have exclusive jurisdiction over any dispute not subject to arbitration.
19. Dispute Resolution and Arbitration
Informal resolution first. Before filing a claim against The Bake-Keeper, you agree to first contact us at the email address below and give us 30 days to informally resolve the dispute.
Binding arbitration. If we cannot resolve a dispute informally, you and The Bake-Keeper agree that any dispute arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. This means you and The Bake-Keeper are each waiving the right to a jury trial and to participate in a class action.
Right to opt out. You may opt out of this arbitration agreement by emailing us at the address below within 30 days of first agreeing to these Terms, stating that you decline to be bound by this arbitration provision.
20. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
21. No Waiver; Entire Agreement
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. These Terms, together with our Privacy Policy and Affiliate Disclosure, constitute the entire agreement between you and The Bake-Keeper regarding the Site and supersede any prior agreements.
22. Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
23. Accessibility
We want the Site to be usable by everyone. If you use assistive technology and encounter a barrier accessing any part of the Site, please contact us at info@thebakekeeper.com describing the issue and the page involved, and we will work with you to provide the information or complete the transaction you need.
